General Terms and Conditions

Foundera AG, Bellerivestrasse 18, 8008 Zurich (hereinafter "Foundera") is the operator of the website www.foundera.ch (hereinafter "Foundera" or "Website").

By accessing Foundera, you as user agree to the following conditions.

1. Information from Foundera

On Foundera you will be provided with information on setting up a business and you will be directed to the consulting and product services of the partner companies represented on the platform (hereinafter "services of partner companies"). Any contracts for services of partner companies arise between users and the respective partner company.

The information and services of partner companies contained on Foundera are intended exclusively for users in Switzerland. They may only be used for private purposes.

2. Linked Websites (links)

Foundera has no influence whatsoever on the design, content and offers of the linked websites (of partner companies) and therefore declines all responsibility for such websites. Access to and use of these websites is at the user's own risk.

3. Costs/Remuneration

The content made available to users on Foundera is free of charge. As soon as users make use of services provided by Foundera or partner companies, costs may arise for the user. Users will be notified in advance by the partner companies if a service is subject to a charge.

4. Duties of care of the user

Users are obliged to protect their mobile phones, tablets, PCs etc. appropriately against misuse by unauthorised persons.

5. Data Protection

Foundera ensures compliance with the legal data protection regulations. More detailed information on this can be found in the data protection declaration.

6. Liability and Warranty

Foundera takes every care to ensure that the content of the website is correct at the time of publication. However, we do not assume any warranty with regard to the correctness, accuracy, up-to-dateness, reliability and completeness of this information. We exclude all liability to the extent permitted by law.

We shall not be liable for any direct or indirect damage resulting from transmission errors, technical defects or failures, malfunctions, network overloads or unlawful interventions or access by third parties, failure to recognise defects in legitimacy, use of the website from abroad, lack of security and/or functionality of the hardware and software used by the user or for any other reasons in connection with the use of the website. Intentional or grossly negligent fault is reserved. Users are aware that, despite all precautionary and security measures, data transmitted via the mobile network or the Internet is not absolutely protected against third-party intervention and that errors or time delays or interruptions may occur. We do not guarantee the continuous and trouble-free functioning of the mobile network, the Internet, the application, the website, nor the correctness and completeness of the displayed, electronically transmitted data. It is the responsibility of users to inform themselves about the necessary security precautions regarding the hardware and software they use and to take appropriate measures in this regard (firewall, virus protection, etc.).

7. Property and Intellectual Property Rights

All property rights remain with us or our partner companies. Users are not permitted to copy or reproduce (including printing on paper) this website in whole or in part.

Except for the purpose stated above, the materials or information available on this website may not be used, in particular reproduced, resold, modified or published, without the prior express written consent of Foundera or the relevant partner company.

The logos, page headers and navigation bars, button icons, graphics and service names are trademarks or trade dress of Foundera. The trademarks and trade dress of Foundera or its affiliates on this platform may not be used in connection with any product or service that is not theirs in any manner that is likely to cause confusion among customers or in any manner that disparages or discredits them.

All other trademarks not owned by Foundera that appear on the Site are the property of their respective owners, who may or may not be affiliated with Foundera.

8. Amendment of Terms and Conditions ("T&C").

We reserve the right to change these TOS at any time. The current version of the T&Cs is available at www.foundera.ch. We will notify you of any changes in an appropriate manner - usually online. Users who do not agree to the changes must terminate the contractual relationship with Foundera within two weeks of notification of the changes. If the contractual relationship is not terminated in good time, the GTC shall be deemed to have been accepted by the user without reservation.

9. Jurisdiction and Applicable Law

The place of jurisdiction for disputes arising from this agreement shall be the Swiss domicile/registered office of the user or the registered office of Foundera in Zurich. The agreement is subject exclusively to Swiss law.
